General Preliminary Remarks

The TU Dortmund University of Technology and its IT and Media Center (ITMC) take the protection of personal data very seriously. We process personal data collected during visits to our websites in compliance with the applicable data protection regulations. In particular, the Data Protection Act of North Rhine-Westphalia (DSG NRW), the General Data Protection Regulation (DSGVO) and the Telemedia Act apply.

I Scope of the processing of personal data

As a matter of principle, we process personal data of our users only to the extent that this is necessary for the provision of a functional website as well as our contents and services. The processing of personal data of our users is regularly only carried out with the consent of the user. An exception applies in those cases where it is not possible to obtain prior consent for factual reasons and the processing of the data is permitted by legal regulations.

 

II Data deletion and storage period

The personal data of the data subject will be deleted or blocked as soon as the purpose of storage ceases to apply. Storage may take place beyond this if this has been provided for by the European or national legislator in Union regulations, laws or other regulations to which the controller is subject. Data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless there is a need for further storage of the data for the conclusion or performance of a contract.

 

III Provision of the website and creation of log files

1. description and scope of data processing

Each time our website is called up, our system automatically collects data and information from the computer system of the calling computer.

The following data is collected in this process:

  • Information about the browser type and the version used
  • Operating system of the user
  • IP address of the user
  • Date and time of access

The data is also stored in the log files of our system. This data is not stored together with other personal data of the user.

2. purpose and legal basis for data processing

The temporary storage of the IP address by the system is necessary to enable delivery of the website to the user's computer. For this purpose, the user's IP address must remain stored for the duration of the session. (Necessity to fulfill the task of the university Art. 6 para. 1 lit. e DSGVO).

The storage in log files is done to ensure the functionality of the website. In addition, we use the data to optimize the website and to ensure the security of our information technology systems. An evaluation of the data for marketing purposes does not take place in this context.  (Necessity for the fulfillment of the task of the university Art. 6 para. 1 lit. e DSGVO).

3. duration of storage

Processing takes place during use until the end of the respective session.

In the case of storage of data in log files, this is the case after 24 hours at the latest. After that, the IP addresses of the users are anonymized, so that an assignment of the calling client is no longer possible.

 

IV Web analysis

Scope of the processing of personal data

TU Dortmund University uses the open source software tool Matomo (formerly PIWIK) to improve its websites by analyzing the surfing behavior of its users.

The software assigns online activities to a single browser session by digital fingerprint and deletes them after 24 hours. Matomo does not set any cookies.

If individual pages of our website are called up, the following data is stored:

  1. Two bytes of the IP address of the calling system of the user.
  2. The website called up
  3. The website from which the user accessed the accessed website (referrer)
  4. The subpages accessed from the accessed web page
  5. The time spent on the website
  6. Which browser with which plugins, which operating system and which screen resolution is used

The software runs exclusively on the servers of the TU Dortmund University website. Personal data of the users is only stored there. The data is not passed on to third parties.

Preventing data recording

You can prevent the recording of data in the manner described above as follows:

You can enable the "Do-not-Track" setting in your browser. Our Matomo system is configured to respect this setting.

V Use of YouTube videos

We offer users on our website the opportunity to watch selected videos from YouTube directly on the site. To protect user data, a connection to YouTube is only established and the video started when a link is clicked. Only then will data be sent to the provider. Unless you click on the link, no exchange takes place between the user and YouTube. VI Contact/suggestion forms and e-mail contact

1. Description and scope of data processing

In the TU Dortmund web presences, there are contact/suggestion forms that can be used for electronic contact. If a user takes advantage of this option, the data entered in the input mask is transmitted to us and stored.

After the form has been sent, the following data is also stored:

  • Date and time
  • URL from which the contact form was sent

For the processing of data, consent is obtained during the submission process and reference is made to this privacy policy.

Alternatively, it is possible to contact us via e-mail addresses provided. In this case, the user's personal data transmitted with the e-mail will be stored.

In this context, the data will not be passed on to third parties. The data is used exclusively for processing the conversation.

2. Purpose of data processing and legal basis

The processing of personal data from the input mask serves us solely to process the contact. In the case of contact by e-mail, this also constitutes the necessary legitimate interest in processing the data.

The legal basis for the processing of the data is Art. 6 para. 1 lit. a DSGVO if the user has given his consent. The legal basis for the processing of data transmitted in the course of sending an e-mail is Art. 6 para. 1 lit. e DSGVO.

3. duration of storage

The data will be deleted as soon as they are no longer required to achieve the purpose for which they were collected. For the personal data from the input mask of the contact form and those sent by e-mail, this is the case when the respective conversation with the user has ended. The conversation is terminated when it can be inferred from the circumstances that the matter in question has been conclusively clarified.

 

VII Rights of the data subject

If personal data is processed by you, you are a data subject within the meaning of the GDPR and you are entitled to the following rights against the controller:

If you wish to exercise your rights, please contact the Data Protection Officer of TU Dortmund University. 

1. information (Art 15 DSGVO)

You have the right to information about personal data concerning you that is collected, processed or, if applicable, transmitted to third parties.

2. objection (Art. 21 DSGVO)
You have the right to object to the processing of your personal data, insofar as the processing is based on Art. 6 (1) e or f DSGVO.

3. deletion (Art. 17 DSGVO)
In particular, after expiry of the legally prescribed retention periods, you have the right to have your data deleted.

4. restriction of processing (Art 18 DSGVO)

In special cases, you have the right to restriction of processing. This is the case if the data processing should be unlawful, you dispute the accuracy of the collected data or have filed an objection against the processing. Likewise, you can request a restriction of processing if the data is subject to an obligation to delete due to the achievement of the purpose, but you need it to assert legal claims. You must request a restriction of processing.

5. Correction (Art 16 DSGVO)
You have the right to correct inaccurate personal data.

6. right to revoke the declaration of consent under data protection law (Art 7 DSGVO)

You have the right to revoke your declaration of consent under data protection law at any time. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

7. right to complain to a supervisory authority

You can contact a data protection supervisory authority at any time with all questions regarding data protection and to complain. In our case, the competent authority is the State Commissioner for Data Protection and Freedom of Information in North Rhine-Westphalia.

Please note that this data protection declaration does not apply to all parts of the TU Dortmund University website.
